Professional/Wedding Fireworks Displays Terms & Conditions
Pyrotex Attendees
All standard professionally fired firework displays include:
1.1 Fireworks; The provision of Category 3 & 4 display fireworks (Category 4
fireworks are for professional use only).
1.2 Site survey; Survey the site and make recommendations on spectator locations,
size and type of fireworks.
1.3 Risk assessment; To minimize the possible risks to public, crew and property
that a firework display may cause.
1.4 Method statement; To inform the client on our working practices by providing
a written work method statement.
1.5 Transport; The transport of Fireworks, Materials and Equipment to and from
display site.
1.6 Labour costs; The total cost incurred by Pyrotex by the use of the work factor.
It includes wage cost plus other costs.
1.7 Materials and Equipment; Provide all materials and equipment to enable
the safe firing of the display ordered.
1.8 Site set-up; The safe set up of
1.9 Pyrotechnics; Execute the fireworks display in a safe, yet spectacular manner
1.10 Soundtrack & Choreography; When ordered, Pyrotex will provide fireworks choreography and soundtrack
1.11 Safety Services; Clean up the firework site, sweep the area for any unfired pyrotechnics.
1.12 Insurance; Public and private liability insurance to the sum of £20m. Where greater cover is required the customer must specify this, no later than 30 days prior to the display. Pyrotex Fireworx reserves the right to invoice additional costs incurred by any such increase.
2.0 Client Attendees
Unless otherwise stated, the client is to provide the following:
2.1 Additional equipment or services required; Equipment related to the display such as crowd safety barriers, safety marshals etc.
2.2 Notification to interested parties; Police, Fire brigade and where applicable any other relevant authority or organisation. It is advisable to notify neighbours, local farmers, livestock owners, hospitals, nursing homes and anyone else who may be affected or distressed by the display. Failure by the event organiser to notify the relevant parties could lead to the display being cancelled.
2.3 Adequate safety in general; It is the responsibility of the event organiser to make sure that adequate safety measures are put in place. This includes firing site perimeter security (unless pre-arranged, where we can supply our own marshals at additional cost) stopping the public from venturing into the firing site during setup or firing. The Display Team Leader has, at any time during the show, the power to stop the show, should the safety of the public and / or the firing crew be compromised.
2.4 Ingress/Egress; To ensure adequate emergency exits and ensure emergency vehicles can gain access to the site. These must be clearly marked out and lit.
2.5 Emergency preparation; To ensure all staff understand what they are to do in the event of an emergency.
2.6 Communication; Keep us in the loop with changes, etc. so we can provide you the best service possible
3.0 Payment
Unless otherwise agreed by both parties:
3.1 Deposits; A 20% deposit is required along with your completed booking form to secure you booking with us. The remaining balance is due no later than two weeks before your show date. If you book a show within two weeks of your show date, then full payment is required upon booking.
3.2 Payment Method; An invoice will be issued upon receipt of booking form and deposit. Payment can be made by BACS, by cheque: payable to Pyrotex Fireworx Ltd, by bank transfer; a/c name: Pyrotex Fireworx Ltd, a/c no.: 0775509, sort code: 309147.
3.3 VAT; All prices shown, quotes given, and invoices issued are valued in UK Sterling and include VAT @ 20%.
3.4 Non-payment; If payment terms are not met then Pyrotex have the right to refuse the firing of the show.
4.0 Variations & Substitutions / Omissions
4.1 Substitutions and omissions; Pyrotex Fireworx reserve the right at any time to substitute and / or omit a pyrotechnic effect from a show which we feel may cause an unacceptable Health and Safety risk. This decision is normally put into effect where excessive wind conditions may cause long duration "hanging" effects to drift towards the audience and / or buildings. In the majority of cases, substitutions are made rather than omissions.
5.0 Termination and Cancellation
5.1 Cancellation giving up to 4 weeks prior to the display date; 20% refund of deposits paid shall be given.
5.2 Cancellations giving less than 2 weeks’ notice from the date of the display; 70% of the display fee will be refunded.
5.3 Cancellations giving less than 1 weeks’ notice from the date of the display; 50% of the display fee will be refunded.
5.4 Cancels on the display date; a 25% of the display fee will be refunded. An extra charge will be made for any fireworks placed in situ prior to cancellation.
5.5 If a show is not allowed to go ahead or cancelled by the venue for any reason outside of Pyrotex Fireworx control; then the same conditions apply above as for a client cancellation.
5.6 If Pyrotex Fireworx make the decision on the day of your show, that your show cannot go ahead due to adverse weather conditions: Pyrotex Fireworx have the right to recover any costs incurred.
5.7 Pyrotex Fireworx will do all they can to ensure that a display goes ahead, however; Pyrotex Fireworx reserve the right to cancel without compensation on the grounds of safety. Pyrotex Fireworx personnel on site have sole responsibility for this decision. Reasons for cancellation include inadequate safety distance, poor crowd control and/or lack of stewards, inadequate or non-existent safety line/fence, livestock in close proximity to the display site.
Note: Pyrotex Fireworx has never cancelled a display due to adverse weather or any other reason. Potential problems are always discussed with the client and we always seek to come to an agreeable cancellation decision, which would in almost every circumstance be based purely on the safety of the Audience and / or Firing Crew.
Online Purchasing Terms & Conditions
General
All orders for goods accepted by Pyrotex Fireworx Ltd, ("the vendor") are accepted subject to the following conditions that shall form part of and govern the contract of sale.
Acceptance of goods shall be deemed to be acceptance of these conditions of sale. Any term sought to be imposed by a purchaser either in a document or otherwise that conflicts with or adds to these conditions is not accepted.
No agent or representative of the vendor has authority to vary these conditions unless accepted in writing by an Authorised Representative of Pyrotex Fireworx Ltd.
Fireworks can only be sold to persons of the age of 18 and over. It is illegal for anyone under 18 to possess fireworks in a public place.
All our firework products conform to CE Regulations and are supplied on the condition they will be used in accordance with the manufacturer’s instructions supplied.
Payment
Payment is to be made via credit card or debit card unless otherwise agreed in writing and no goods will be dispatched until payment has been made to the vendor. All credit card companies now require address verification (your credit card billing address) on all mail order transactions. An incorrect billing address will result in a delayed or cancelled order.
Our policy requires 100% prepayment in advance for any orders made from this website. Such payments are not refundable once the merchandise is ordered except as shown in these terms.
Price
All prices are in UK Pounds £ sterling and include VAT at the current rate. Delivery charges are not included in product prices unless specified.
In the event a product is listed at an incorrect price due to a typographical error or error in pricing information from our suppliers, taxes or duty changes, we shall have the right to refuse any orders listed at the incorrect price. This also applies to typographical errors of product descriptions and delivery charges
Delivery
In order for your fireworks to be delivered promptly and safely we use our own staff and vehicles to transport hazardous and explosive goods such as fireworks.
FREE - On all orders over £500.00. Any order under £500 will incur a cost for delivery. This depends on your geographical location.
FREE - Collection
As fireworks are classed as explosives, we have to employ the use of a specialist courier to deliver your order. Please note that our delivery charge is a contribution towards the high costs of packing and shipping your order, we subsidise the rest.
Deliveries are made between 9:00am and 5:00pm Monday to Friday. You must make sure you are available to take delivery. For this reason, we strongly recommend you use a work address or similar because failed delivery attempts may be charged
Please make sure there will be someone (over the age of 18) at the delivery address to avoid the extra charge for re-delivery.
You will be asked for your delivery address when you checkout your order. Fireworks cannot be left without a signature and cannot be sold to anyone under 18 years of age.
If you have any special requirements or have any other requests such as express delivery, you should telephone us and discuss this directly.
Due to the very nature of our business, throughout November and December including New Year’s Eve we are very busy and will not be able to deliver any items to any location.
All items offered on our website are subject to availability. Where an individual product is unavailable we will try to contact you and offer an alternative. If a product is unavailable, we reserve the right to substitute this with a similar item of equal or greater value.
Liability
No liability for any claim for damage shall be accepted unless the purchaser notifies the vendor within seven days of delivery. This period may be extended at the sole discretion of the vendor.
No liability for any claim for missing items shall be accepted unless the purchaser notifies the vendor within seven days of delivery.
No liability for any claim will be accepted in the case of goods differing in quantity or descriptions from the purchaser given on the order unless the vendor is notified in writing by the purchaser within seven days of delivery.
No consequential losses arising out of the use of any products will be accepted
Returned Goods
If your goods are faulty then a full refund will be forthcoming on the receipt and inspection of the goods...
In such cases Pyrotex Fireworx Ltd will arrange for our staff to collect these items from you. (It is illegal to send the items through the postal service or an unlicensed courier)
The vendor reserves the right to charge a restocking fee on goods returned for credit which are not in stock condition and where notification has been given by the purchaser of any damage to the goods within seven days.
The purchaser shall unless otherwise stated be responsible for the cost incurred of Pyrotex Fireworx Ltd collecting the goods.
All items claimed to be faulty returned to the vendor by pre-arrangement and found to contain no fault, will be subject to a 25% restocking charge, provided the goods are in original stock condition. Any downward variation of this restocking charge shall be at the sole discretion of the vendor.
The vendor shall give a 21 day return full guarantee to refund to the purchaser full credit for any goods returned in stock condition which shall not affect the rights of the consumer or purchaser under any statutory rights.
No credit shall be allowed for goods until they have been received complete.
A full credit will only be given on items collected within 14 days from delivery.
If a credit is to be given, the original carriage charge will not be refunded / credit if applicable.
Refused Shipments : Shipments returned marked refused, or not in when driver called will not result in refund and refusal of a shipment does not relieve the customers liability for paying any charges. If the delivery fails due to no one being present at the premises or not old enough, our staff will have no choice but to return the items back to our head office. An additional Charge will be made to re-attempt the delivery, if this happens we will automatically debit your card. Unfortunately, fireworks cannot be left without a signature.
Law
If any part of these terms and conditions shall be found to be unlawful it shall not affect the validity or enforceability of the remainder of the conditions.
These terms shall be deemed to have been made in England and shall in all respects be governed by English Law.
In respect of consumer sales only, statutory rights are unaffected by these terms and conditions.
Purchasers must be eighteen years of age or over. Fireworks can only be sold to persons eighteen years of age or over, with no exceptions at all.
It is illegal to sell adult fireworks to anyone under 18.
It is illegal for anyone under 18 to possess fireworks in a public place.
